Terms and Conditions of Sale

Chronodisk, a 100% French computer data recovery laboratory.

Article I: Purpose of the service

Chronodisk undertakes to devote all its resources and expertise to recovering the data from the media handed over by the customer. This service does not include configuring or reinstalling software to its original state, restoring the operating system, or configuring email or databases.

Article II: Preparation of the quote

Your free quote will be sent to you by email within 4 to 6 hours (guaranteed) for business customers and 48 hours (not guaranteed) for private customers. It will set out the nature of the fault detected, the applicable package and the time needed to recover your data (plus the list of files that will be restored in the case of a logical fault or a first-degree physical fault).

Article III: Data restoration media

Your data is recovered onto a USB flash drive provided free of charge (up to 14 GB of restored data), and onto an external backup hard drive above 14 GB of data. We supply a drive sized to the recovered data. This hard drive is guaranteed for 1 year: in the event of a malfunction, we recover the data free of charge. All the drives we supply are new.

Article IV: Data recovery lead times

For business customers, data recovery usually takes place 24 to 48 hours after your acceptance of the quote and payment of the commitment fee for logical faults, and 5 to 14 days (depending on the severity of the fault and the rarity of the drive) for work in the ISO 5 Class 100 cleanroom. For private customers, the lead time is a minimum of 3 days for a logical fault and 3 to 5 weeks for cleanroom work.

Article V: Confidentiality

We undertake to maintain absolute confidentiality not only regarding your data, but also regarding your identity. In particular, no commercial publication will ever mention your identity without prior authorisation.

Article VI: Retention of the original media and spare parts

In the event of a physical fault, and unless you have specified that you want your drive reassembled for a fee of €60 excl. VAT by ticking the box provided on the intake form, only your recovered data is returned to you (the additional spare parts used in processing your case remain the property of our company and are not returned to you. Removing the spare parts used in the cleanroom and reassembling them to their original state would oblige us to charge you a service fee far higher than the value of these parts). If you decline our quote, you may collect your hard drive free of charge by coming to our premises (only at our registered office in Paris 15, located at 20-22 rue Louis Armand). Your hard drive can be returned to you on payment of the return shipping costs for your drive (usually €25 excl. VAT by private carrier). Whether you decline or accept our quote, you have 2 calendar months from the date the quote was issued to collect your hard drive or send us payment of the return shipping costs. Beyond this period, without a response from you, your hard drive will be kept for spare parts and, for confidentiality reasons, the platters of your drives will be irreversibly destroyed. Your case will then be permanently closed with no possible recourse on your part.

Article VII: External hard drive components and personal items

Please send us your hard drive “bare” wherever possible, without screws or any additional mount, as we cannot guarantee to return them to you. We do not keep packaging, padding or any container used to ship the drive, so you cannot claim their return. If your drive is still in its external enclosure or in its original laptop, we can extract it free of charge in most cases, but you remain aware that your enclosure or your computer may be damaged by the operation, or even destroyed in some very rare cases. We accept no liability for any marks caused by such an operation. Reassembling the drive into its original enclosure will be charged at €60 excl. VAT if the device is deemed too complex by our engineers. In addition, removing and reassembling a hard drive inside a complex device will be charged as follows: €60 excl. VAT for removal (refunded or not charged if you accept our data recovery quote) and €60 excl. VAT for reassembly (charged in all cases). The complexity of removal and reassembly will be indicated to you when the device is handed in.

Article VIII: Payment

At the end of the data recovery process, the invoice issued is payable in full on receipt. Any deferred payment incurs a monthly penalty of 2%, payable without any reminder being required on our part, in accordance with the legal provisions of Article L441-3 et seq. of the French Commercial Code and the NRE Act of 15 May 2001. If you accept your quote and your data is subsequently recovered, you must pay your invoice within one month of its date of issue. Any late payment will give rise to the penalties applicable under current law and to referral to our specialist debt collection firm.

Article IX: Commitment fee

When your hard drive, RAID, SSD or removable memory is processed, the amount paid as a commitment fee, covering the cost of parts, supplies and the engineers’ investigations, cannot be refunded to you, even in the event of failure.

Article X: Emergency packages

If you choose recovery within 2, 6 or 24 hours after the quote, you must pay the corresponding amount even if you decline your quote or if data recovery is only partial. However, this package will only be charged to you if the guaranteed turnaround time is actually met (the time at which a list of recovered files is sent by email for your verification being deemed authoritative).

Article XI: Price list

The applicable price list depends on the nature of your data, according to whether it is private or business in nature. The discount reserved for private customers cannot be applied if the data on the media is business-related (invoicing, accounting, HR files, etc.). If, after your agreement and extraction of your data, we find that it is business-related, the discount previously granted to you will be removed from your invoice, without you being entitled to the emergency lead times reserved for business customers. An increase in your invoice on these grounds does not release you from your contractual obligations, and you must therefore pay it. Private customers benefiting from the discount reserved for them may not have their invoice issued in the name of a company, and undertake to use a private means of payment.

Article XII: Opening hours

Chronodisk provides information every day, 24 hours a day, on its interactive voice server on +33 1 40 60 00 00 (+33 1 40 60 00 00). Our registered office has a street-front entrance at 20-22 rue Louis Armand (Paris 15th) and is open Monday to Friday from 9am to 6pm and on Saturday from 10am to 3pm.

Article XIII: Quality

Data for which our engineers have not observed any error during the process is deemed to have been recovered. The operation will also be considered a success if the data indicated by the customer on the intake form is present in the list of recovered data.

Article XIV: USB flash drives

Analysing USB flash drives most often involves dismantling, or even destroying, the device. The customer entrusts their equipment to us in full knowledge of this, and may not claim reassembly or compensation.

Article XV: Disputes

Any dispute relating to the conclusion, performance, termination or interpretation of the contract between the parties shall fall within the jurisdiction of the courts of Paris.
